State Supreme Court Gives Manke Another Win

Judge Cautions State to Stop Trying to Shut Owosso Barber Down

On Friday the Michigan Supreme Court unanimously ruled in favor of Owosso barber, Karl Manke, saying that the state court of appeals decision raised questions and called the issuance of a preliminary injuction "inexplicable."  

Justice David F. Viviano wrote “It is incumbent on the courts to ensure decisions are made according to the rule of law, not hysteria," adding "one hopes that this great principle — essential to any free society, including ours — will not itself become yet another casualty of COVID-19.”

The Attorney General's office filed a motion last week to hold Manke in contempt, incurring thousands of dollars each day in fines, for operating.

35th Circuit Court Judge Matthew Stewart, who previously declined to shut Manke down at the state's request, issued an order telling the state it is no longer appropriate to continue to try to go after Manke.

"It is no longer appropriate for Plaintiff to seek to compel Defendant to comply with a nonexistent injunction," the order says.

The order also calls into question whether or not the request for a preliminary injunction is moot as the Governor has formally announced that barber shops and salons will be allowed to reopen on June 15th.

Manke's license remains suspended.

A hearing is scheduled for Thursday this week.
