Chalking tires, a practice commonly used in parking enforcement; one that we've all experienced at one time or another in Owosso, has been ruled unconstitutional by a federal appeals court.

It began with a lawsuit by a woman against the city of Saginaw.  Now the issue has taken the national spotlight.

We're told the City of Owosso has ceased the practice after Monday's ruling, which found that chalking tires violated the fourth amendment; freedom from unreasonable search and seizure.

In 2017, a Judge dismissed the case, siding with the City of Saginaw's representation, that chalking does not amount to search, and even if it did, it would not be unreasonable.  However the sixth circuit court of appeals in Cincinatti on Monday disagreed.

Now, the discussion of new methods to track parking infractions, such as overstaying time limits, has become a hot topic.
